1. Acceptance of Terms
By using Gutter Guy Melbourne or submitting a service request, you agree to these Terms and our Privacy Policy. If you disagree, please refrain from using this site.
2. Nature of Services (Matchmaker Model)
We operate a lead-generation and matchmaking platform. Gutter Guy Melbourne does not perform gutter cleaning or repairs. We connect customers with independent contractors who hold valid ABNs and insurance. Once contact details are exchanged, the agreement continues directly between the two parties.
3. Payments & Financial Independence
All payments for work are strictly between the customer and the independent provider. We do not handle funds, issue invoices, or mediate payments. Disputes over pricing or quality must be resolved directly between the customer and provider.
In limited cases (duplicate lead billing or verified system errors), we may offer discretionary refunds or credits to providers only. This does not establish liability or agency.
4. ABN Verification & Provider Responsibilities
All providers listed through Gutter Guy Melbourne must operate under a valid Australian Business Number (ABN). We may verify ABN details through public data sources such as the Australian Business Register to confirm the business name and status at the time of registration.
We do not verify, confirm, or guarantee a provider’s insurance coverage, licenses, qualifications, or ongoing compliance. Providers are solely responsible for ensuring they meet all legal, safety, and operational requirements relevant to their trade.
Customers are encouraged to request proof of insurance or compliance documents directly from the provider before engaging their services.
5. Liability, Warranties & Indemnities
We provide introductions “as-is” and make no warranties about service outcomes. Gutter Guy Melbourne is not liable for property damage, personal injury, or losses arising from work performed by independent providers. You agree to indemnify us from claims resulting from your direct dealings.
6. Communication, SMS & Consent
By submitting a job request, you consent to receive job-related SMS or emails. We comply with the Spam Act 2003 (Cth) and the Australian Privacy Principles (APPs). Providers must communicate professionally and only within reasonable hours (8:00 AM – 8:00 PM).
7. Intellectual Property & Acceptable Use
All website content, logos, and text belong to Gutter Guy Melbourne. You may not reproduce, copy, or modify any content without written consent. Providers must not misuse customer data or represent themselves as Gutter Guy employees.
8. Suspension & Termination
We may suspend or terminate access for fraudulent activity, data abuse, or policy breaches without notice. Repeat offenders may be permanently banned from our platform.
9. Governing Law (VIC)
These Terms are governed by the laws of Victoria, Australia. Disputes shall be resolved under Victorian jurisdiction.
